What Wishberry does

Wishberry provides tools for creating and sharing birthday pages containing celebration information, gifts, interests, RSVPs and related content.

Wishberry helps people communicate gift ideas. Unless expressly stated otherwise, Wishberry does not sell the gifts listed on a Wishberry and is not the retailer, seller or payment processor for purchases made through external websites.

Beta service

Wishberry is currently in beta.

This means features may be added, removed, changed or improved as the service develops. Bugs, interruptions and other unexpected behaviour may occasionally occur.

We may modify or discontinue beta functionality where reasonably necessary to develop, maintain or protect the service.

Host accounts

Hosts currently use a ChatGPT/OpenAI account to sign in to Wishberry.

You are responsible for maintaining appropriate control of the account you use to access Wishberry and for activity carried out through your host access.

Guests do not currently need a Wishberry account to access a valid shared Wishberry link.

Creating a Wishberry for someone else

You may create a Wishberry for yourself or for another person, such as your child, partner, friend or family member.

If you create one for someone else, you are responsible for ensuring that you have an appropriate basis or permission to provide and share their information.

Take particular care when creating a Wishberry for a child. Do not include sensitive or unnecessary personal information.

Your content

You are responsible for the information and content you add to Wishberry, including:

• names and descriptions;
• celebration details;
• photographs and other images;
• gift information;
• links; and
• other material you submit.

You should only upload or share material that you have the right to use.

Do not use Wishberry to publish unlawful, harmful, abusive, deceptive or otherwise inappropriate material.

Shared links

Wishberries are currently shared using unique links.

A shared Wishberry is intended for the people with whom its host shares that link, but the link itself may be forwarded or otherwise obtained by others.

You should not treat link-only access as equivalent to password-protected access.

Gifts and external links

Hosts may add links to gifts available from external websites.

Wishberry does not guarantee:

• the availability of an item;
• the accuracy of a retailer’s price or description;
• that an external link will remain active;
• the quality or suitability of a product or service; or
• the performance of a third-party retailer or provider.

Prices displayed on Wishberry are entered by the party host and are intended to be informational. They may differ from the price ultimately charged by a third-party seller.

Purchases and payments

Wishberry does not currently process gift purchases or hold money on behalf of hosts or guests.

When you follow a gift link and purchase something from an external website, that transaction is between you and the relevant third party.

Their prices, delivery terms, returns, refunds, warranties, privacy practices and other terms apply to that transaction.

Gift status

Features such as Available, Picked with love, and Gifted are intended to help hosts and guests coordinate gifting.

These statuses should not be interpreted as confirmation from a retailer that an item has been purchased, paid for, shipped or delivered unless Wishberry expressly states otherwise.

RSVPs

Wishberry may allow guests to submit RSVP information through a shared Wishberry.

Hosts are responsible for using RSVP information appropriately and only for purposes reasonably connected with the celebration.

Wishberry does not guarantee attendance or the accuracy of information submitted by guests.

Guests cannot currently edit a submitted RSVP through Wishberry. If their plans change, they should contact the host directly.

Acceptable use

You must not knowingly:

• misuse or interfere with Wishberry;
• attempt to gain unauthorised access to another host’s account or Wishberry;
• use automated means to abuse or overload the service;
• upload malicious code;
• use Wishberry for fraud or unlawful activity; or
• use the service in a way that infringes another person’s rights.

Availability

We aim to keep Wishberry available and working reliably, but uninterrupted or error-free operation cannot be guaranteed, particularly while the service remains in beta.

Maintenance, technical problems or product changes may occasionally affect availability.

Changes to Wishberry

Wishberry will continue to evolve.

We may change features, interfaces or functionality and may introduce, modify or discontinue features as the product develops.

If paid functionality is introduced in the future, applicable pricing and terms should be clearly communicated before a user chooses to purchase it.

Responsibility for third parties

Wishberry may contain links to websites and services that we do not operate.

We are not responsible for third-party websites, their content, availability, products, transactions or practices.

Limitation of responsibility

To the extent permitted by applicable law, Wishberry is provided on an “as available” basis.

Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited.

Privacy

Use of personal information in connection with Wishberry is described in the Privacy Policy.

Changes to these Terms

These Terms may be updated as Wishberry develops.

The latest version will be published here with the date it was last updated.
